These Terms govern your use of SWPPP Builder (swpppbuilder.com) and the documents it generates. By using the site or purchasing a product, you agree to these Terms. Please read them, especially the disclaimer and limitation of liability sections.

1. What SWPPP Builder is, and is not

SWPPP Builder is a software tool that helps you prepare a self-prepared Stormwater Pollution Prevention Plan (SWPPP) for construction sites in Tennessee, based on information you provide. It generates a document formatted to Tennessee's Construction General Permit (NPDES Permit No. TNR100000) and related TDEC forms.

SWPPP Builder is not a law firm, an engineering firm, or a provider of professional engineering or legal services. Using the tool does not create an engineer-client, attorney-client, or other professional relationship. The documents it produces are self-prepared documents that you are responsible for reviewing, completing, signing, and submitting.

2. Eligibility and proper use

The products are intended for eligible Tennessee contractor SWPPPs, approved-plan packages, and single-family residential CN-1249 packages. Some projects (for example, those involving sediment basins, engineered controls, stream or wetland impacts, impaired waters, large or steep drainage areas, or local sealed-plan requirements) may require engineer-stamped plans or professional review. You are responsible for determining whether your project is appropriate for a self-prepared SWPPP.

The site and the documents are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

SWPPP Builder does not warrant or guarantee that a generated document will be accepted by any regulatory authority, will satisfy every requirement of your permit, or will prevent any violation, fine, penalty, or enforcement action. Compliance depends on the accuracy of the information you provide, the specifics of your site, and your own actions in the field.

5. Limitation of liability

To the maximum extent permitted by law, SWPPP Builder and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any fines, penalties, enforcement actions, lost profits, or lost business, arising out of or related to your use of the site or any generated document.

To the maximum extent permitted by law, the total liability of SWPPP Builder and its owner for any claim arising out of or related to the site or a product will not exceed the amount you paid for the product giving rise to the claim.

6. Refunds

SWPPP Builder products are digital documents generated and delivered immediately upon purchase, so all sales are final once your document has been generated. However:

7. Payments

Payments are processed by Stripe. By purchasing, you authorize the applicable charge. Prices are shown at checkout and may change over time. You are responsible for any applicable taxes unless stated otherwise.

8. Intellectual property

The site, its design, and its underlying software are owned by SWPPP Builder and are protected by applicable law. Upon payment, you receive a license to use the document generated for your project for your own permitting and compliance purposes. You may not resell, redistribute, or repackage the tool or its outputs as a competing service.

9. Indemnification

You agree to indemnify and hold harmless SWPPP Builder and its owner from any claims, losses, liabilities, and expenses arising out of your use of the site or a generated document, your violation of these Terms, or your violation of any law or permit requirement.

10. Governing law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Tennessee.

11. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will reflect the most recent version. Your continued use of the site after changes are posted constitutes acceptance.
